Hover Greens App — Terms of Service

Welcome to Hover Greens!

These Terms of Service ("Terms") govern your access to and use of the Hover Greens mobile application ("App"), developed and operated by Hover Greens ("Hover Greens," "we," "us," or "our"), a business based in Maryland, United States.

By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, you should not use the App.

1. Description of Services

The Hover Greens App provides interactive golf putting training software, visual alignment tools, slope visualizations, practice exercises, games, and other golf-related features.

The App may be used independently or in conjunction with compatible Hover Greens putting platforms, projection systems, and related equipment.

Features may include, but are not limited to:

Putting alignment and aiming tools
Slope and break visualizations
Putting speed and tempo training
Interactive putting games and practice exercises
Golf training calculations and visual references
External display and projection compatibility
Integration with compatible golf training equipment

Hover Greens reserves the right to modify, improve, add, suspend, or discontinue features at any time, subject to applicable law.

2. Eligibility and User Responsibilities

By using the App, you represent that you are legally permitted to use the App under the laws of your jurisdiction.

Users under the age of majority in their jurisdiction should use the App with the permission and supervision of a parent or legal guardian.

You agree to use the App responsibly, follow applicable laws, and comply with these Terms.

3. License to Use the App

Hover Greens grants you a limited, nonexclusive, nontransferable, revocable license to download, install, and use the App on compatible devices for lawful personal, educational, recreational, or internal business training purposes.

This license does not transfer ownership of the App or its underlying software.

You may not:

Copy, reproduce, modify, or redistribute the App without authorization.
Reverse-engineer, decompile, or attempt to extract the App's source code, except where expressly permitted by applicable law.
Sell, sublicense, or commercially redistribute the App without written permission.
Remove copyright, trademark, or proprietary notices.
Interfere with the App's functionality, security, or operation.
Use the App for unlawful or fraudulent activities.

All rights not expressly granted remain reserved by Hover Greens.

4. Golf Training Information and Accuracy

The App provides visual references, calculations, and training tools intended to assist users in practicing and improving their putting skills.

Certain features may estimate putting breaks, slopes, ball paths, green speeds, alignment positions, and other golf-related measurements.

These calculations and visualizations are provided for informational, educational, and recreational purposes.

Actual putting results may vary based on factors including:

Putting surface characteristics and conditions
Green speed and slope
Equipment setup and calibration
Ball characteristics
Environmental conditions
Individual putting technique
Projection alignment and display settings

Hover Greens does not guarantee the accuracy of all calculations, visualizations, or projected ball paths.

The App does not guarantee improved putting performance, lower golf scores, or specific training outcomes.

Users are responsible for evaluating the suitability of the App's training information for their individual circumstances.

5. Equipment Compatibility and Safety

The App may be used with putting greens, projectors, cameras, electronic devices, adjustable platforms, golf clubs, golf balls, and other training equipment.

Users are responsible for ensuring that all equipment is properly installed, maintained, and operated.

When using the App with physical equipment, users should:

Follow all manufacturer instructions and safety guidelines.
Ensure that putting platforms and associated equipment are stable and secure.
Maintain adequate clearance around moving equipment and putting areas.
Keep people and objects clear of golf club swings and moving golf balls.
Avoid operating damaged, improperly installed, or malfunctioning equipment.
Exercise caution when using electrically powered or mechanically adjustable systems.

The App is not intended to replace proper equipment installation, inspection, maintenance, or supervision.

To the extent permitted by applicable law, Hover Greens is not responsible for injuries, accidents, equipment damage, or property damage caused by improper installation, unauthorized modifications, negligent operation, or misuse of equipment.

Nothing in these Terms excludes or limits liability that cannot legally be excluded.

6. Intellectual Property Rights

The Hover Greens App, including its software, source code, graphics, layouts, visualizations, designs, training tools, interactive games, branding, logos, and other original content, is owned by Hover Greens or its licensors.

These materials are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

Unauthorized reproduction, distribution, modification, or commercial exploitation is prohibited.

The Hover Greens name, associated branding, and product names may not be used in a manner that falsely suggests endorsement, sponsorship, or affiliation without prior written permission.

Nothing in these Terms grants ownership of any Hover Greens intellectual property.

7. Privacy and Data Protection

Your privacy is important to Hover Greens.

Our Privacy Policy explains how the App handles information, device permissions, and applicable privacy practices.

The App may require access to certain device capabilities, such as Bluetooth, camera functionality, or device storage, depending on the features used.

Our handling of personal information, if any, will be governed by the Privacy Policy and applicable data protection laws.

For users in the European Economic Area, United Kingdom, and other jurisdictions with applicable privacy protections, Hover Greens will comply with relevant legal obligations to the extent they apply to our operations.

8. App Availability and Updates

Hover Greens strives to provide a reliable and functional application.

However, we do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device.

We may periodically release updates to:

Improve performance and stability
Introduce new features
Correct software errors
Improve device compatibility
Address security concerns
Maintain compliance with applicable requirements

Certain updates may be necessary for continued functionality.

Hover Greens reserves the right to modify or discontinue features, subject to applicable law and any rights users may have regarding paid digital content or services.

9. Third-Party Platforms and Services

The App may be distributed through third-party platforms, including Google Play, and may operate with Android devices, external displays, projectors, and compatible hardware.

Your use of these platforms and devices may be subject to additional terms, conditions, and privacy policies established by their respective providers.

Hover Greens is not responsible for service interruptions, compatibility issues, or technical failures caused by third-party systems outside our reasonable control.

Nothing in these Terms changes any rights you may have under applicable third-party platform agreements or consumer protection laws.

10. Fees and Purchases

The App may be made available without a download fee.

Physical Hover Greens products, equipment, and accessories may be sold separately and are subject to the applicable terms, pricing, and policies presented at the time of purchase.

Unless expressly stated otherwise, downloading the App does not include the purchase of physical equipment or accessories.

If paid software features, subscriptions, or in-app purchases are introduced in the future, Hover Greens will provide applicable pricing, payment terms, and cancellation information before purchase, as required by law.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis.

Hover Greens makes no guarantee that the App will:

Operate without interruption or technical errors.
Be compatible with all devices, projectors, or hardware.
Produce perfectly accurate training calculations.
Meet every user's individual training requirements.
Deliver specific golf performance improvements.

To the extent permitted by applicable law, Hover Greens disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Nothing in these Terms excludes or restricts statutory warranties, consumer guarantees, or other rights that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Hover Greens shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to the use of, or inability to use, the App.

This includes, where legally permitted, losses arising from:

Software interruptions or malfunctions
Inaccurate training calculations or visualizations
Device or equipment incompatibility
Loss of access to App features
Improper use of the App or associated equipment

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such exclusion is prohibited, willful misconduct, or any other liability that cannot lawfully be excluded or limited.

13. User Conduct

You agree not to use the App in any manner that could damage, disable, overburden, or impair its operation.

You also agree not to attempt unauthorized access to the App, its underlying systems, or related services.

Hover Greens reserves the right to take reasonable action against misuse, including restricting access where technically feasible and legally permitted.

14. Termination

You may stop using the App at any time by uninstalling it from your device.

Hover Greens may suspend or terminate your permission to use the App if you materially violate these Terms, subject to applicable law.

Upon termination, your license to use the App ends.

Provisions relating to intellectual property, disclaimers, limitations of liability, and other provisions intended to survive termination will remain effective to the extent permitted by law.

15. International Availability and Users

The Hover Greens App may be distributed and accessed internationally, including in the United States, European Economic Area, United Kingdom, and other countries.

Users are responsible for complying with applicable local laws when accessing and using the App.

Hover Greens makes no representation that every feature or associated hardware product is available, compatible, or appropriate for use in every country.

Nothing in these Terms limits or excludes mandatory consumer rights available under the laws of a user's country of residence.

For users in the European Economic Area, United Kingdom, or other jurisdictions with mandatory consumer protection laws, those protections take precedence over conflicting provisions of these Terms.

Where applicable law permits consumers to bring legal proceedings in their country of residence, these Terms do not restrict that right.

16. Compliance With Applicable Laws

Hover Greens intends to operate the App in accordance with applicable laws and regulations in jurisdictions where the App is distributed.

Users agree to comply with applicable laws relating to software usage, intellectual property, and the operation of connected equipment.

If any provision of these Terms conflicts with a mandatory legal requirement, the applicable legal requirement will control.

17. Changes to These Terms

Hover Greens may update these Terms periodically to reflect changes in:

App functionality
Business operations
Legal or regulatory requirements
Security or technical considerations
Services and supported equipment

Updated Terms will be published with a revised effective date.

Where required by applicable law, we will provide additional notice or request user consent before material changes take effect.

Continued use of the App after updated Terms become effective constitutes acceptance only where permitted by applicable law.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles.

Any disputes arising from these Terms shall be subject to the jurisdiction of the appropriate courts in Maryland, except where mandatory consumer protection or jurisdictional laws provide otherwise.

For international users, nothing in this section deprives consumers of mandatory legal protections or rights to bring proceedings in their country of residence where applicable law provides those rights.

19. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between you and Hover Greens regarding use of the App, except where additional applicable agreements or mandatory legal rights apply.

These Terms do not replace separate purchase agreements, warranties, or other terms governing physical Hover Greens products.
